Secretary's List of Crimes and Negative Actions

Certain criminal convictions, pending charges, and negative actions automatically disqualify an individual from having unsupervised access to vulnerable adults, juveniles, and children. Below is a list by program area of those disqualifiers.

Chapter 388-113 WAC: Disqualifying Crimes and Negative Actions   for programs administered by Aging and Long-Term Support Administration and Developmental Disabilities Administration:

  • Home and Community Services Division programs, including but not limited to:
    o   In-home Service Providers
    o   Home Care Agencies
    o   Individual Providers
  • Residential Care Services Division programs, including but not limited to:
    o   Nursing Homes
    o   Assisted Living Facilities
    o   Adult Family Homes
  • Developmental Disabilities Administration, including but not limited to:
    o   Group Homes
    o   Providers

The Secretary's List of Crimes and Negative Actions  for programs administered by Children's Administration, including but not limited to:

  • Foster Care Licensing
  • Adoptions
  • Providers

The Secretary's List of Crimes and Negative Actions  for all other programs administered by the Department including, but not limited to:

  • Economic Services Administration
  • Financial Services Administration
  • Juvenile Justice and Rehabilitation Administration
  • Division of Vocational Rehabilitation
  • Special Commitment Center
  • Office of Deaf and Hard of Hearing
  • All other programs and state employees
