FINAL AMENDMENTS RELATED TO CHAPTER 388-101 WAC
Dear Certified Community Residential Services Provider and Interested Parties:
In August and December 2013, Residential Care Services (RCS) informed you about possible changes to Community Residential Services certification rules. The department recently filed the final Rule-Making Order (CR-103) for amendments to Chapter 388-101 Washington Administrative Code (WAC), Certified Community Residential Services and Supports, with the Office of the Code Reviser. The permanent rule became effective on May 29, 2014 and is published in the Washington State Register as WSR 14-10-028.
The purpose of amending these rules is to comply with changes to state law made by the 2013 Legislature in Senate Bill (SB) 5510, Vulnerable Adults – Abuse. In addition, the department is amending rules to comply with Substitute House Bill (SHB) 2056, Assisted Living Facilities (Chapter 10, Laws of 2012).
- Changes related to SB 5510 include amending the definition of the term "neglect."
- Changes related to SHB 2056 (Chapter 10, Laws of 2012) include replacing the term "boarding home" with "assisted living facility."
Enclosed is the CR-103. You can also access this on the ADSA website under the heading, "CRS Rule Filings", at: http://www.altsa.dshs.wa.gov/professional/crs.htm.
After the effective date, when the rule language is "codified" and merged into the existing WAC chapter, you will be able to read and print them out from the computer by visiting http://apps.leg.wa.gov/WAC/default.aspx?cite=388-101.
Thank you for your continued support of and instruction to the department's vulnerable clients. If you have any questions, please contact Robert McClintock, Quality Assurance Administrator at (360) 725-2419 or by e-mail at mcclir@dshs.wa.gov.
