The purpose for this rulemaking is to consolidate the rules related to background checks, negative actions, and Character, Competence and Suitability (CC&S) determinations between Home and Community Services (HCS), Residential Care Services (RCS), and Developmental Disabilities Administration (DDA). On September 1, 2023, the Department of Social and Health Services (department) withdrew CR-101’s under WSR 18-17-159, WSR 18-17-175, and WSR 18-17-177. Previously, on July 22, 2022, the department withdrew CR-101 under WSR 18-17-178. These CR-101s were part of an ongoing background check rule-making project that started in November 2017. On October 6, 2023, the department consolidated the information and refiled a single CR-101 under WSR 23-21-034.
DSHS is conducting rulemaking which may amend the following WAC chapters:
- Chapter 388-76 WAC, Adult Family Home Minimum Licensing Requirements,
- Chapter 388-78A WAC, Assisted Living Facility Licensing Rules,
- Chapter 388-97 WAC, Nursing Homes, and
- Chapter 388-107 WAC, Licensing Requirements for Enhanced Services Facilities.
The cross program rulemaking project filed on October 6, 2023 will address the following subjects:
- Consolidate the rules related to background checks, negative actions, and Character, Competence, and Suitability (CC&S) determinations between Home and Community Services (HCS), Residential Care Services (RCS), and Developmental Disabilities Administration (DDA).
- Provide clarity and understanding of WAC language for the public and contracted entities.
- Preserve the health and safety of residents living in Adult Family Homes, Assisted Living Facilities, Nursing Homes, or Enhanced Servies Facilities.
