The department is adding new, repeal, and amend sections in chapters 388-97 WAC, Nursing Homes (NH), 388-76 WAC, Adult Family Homes (AFH), 388-78A WAC, Assisted Living Facilities (ALF), and 388-107 WAC, Enhanced Services Facilities (ESF). The rules have not been updated in several years. The rules need to be updated in consideration of the Centers for Disease Control and Prevention recommendations. These rule changes will create consistent regulations across the residential care services programs.
The status of this rulemaking project is active
DSHS is conducting rulemaking which may amend the following WAC chapters:

- Chapter 388-78A WAC
- Chapter 388-76 WAC
- Chapter 388-107 WAC]
This rule making project will address the following subjects:
- Tuberculosis screening and testing in nursing homes, assisted living facilities, adult family homes and enhanced services facilities.
- Additional subjects include timelines for testing and retesting requirements, testing methods, symptom screening, individual baseline and risk assessments, reporting requirements, test records, documentation related to testing, and historical testing.
